FLEXDOG Terms and Conditions

Introductory Information

These terms and conditions of a company FLEXDOG s.r.o., with its registered seat at Mánesova 917/28, Vinohrady, 120 00 Prague 2, ID No.: 095 29 128, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 337659 (hereinafter the „FLEXDOG“), regulate mutual rights and obligations between the Company, who is the owner and operator of a website located at www.flexdog.com (hereinafter the „Website“), and each visitor to the Website (hereinafter the „User“). The User means each visitor to the Website.

By accessing and using the Website, you agree to these terms and conditions and confirm that you have read them and agree with their content.

Basic Terms of Service

The Website is not an e-shop or an online store and the presented products are not sold through the Website. All presentation of products on the Website is informative and cannot be considered as an offer to conclude a purchase or other similar contract.

The subject of FLEXDOG’s business is the aggregation of offers from selected e-shops and online stores and the brokerage of possibility of concluding a purchase or similar contract with a third party. The Website contains links to third-party websites, apps and other online properties that are not owned or controlled by FLEXDOG. FLEXDOG is not a party to the transactions between the User and a third party and no purchase or other similar contract is concluded between FLEXDOG and the User.

Although FLEXDOG strives to keep all information presented on the Website up to date, FLEXDOG does not guarantee the truth or accuracy of the information on presented products (such as the price, availability, description, design and quality). FLEXDOG’s goal is to connect the User, with a selected and trusted e-shop or an online store, and thus allow the User to purchase a product in the required size and quality at the presented price. However, due to the fact that FLEXDOG does not own or sell presented products, FLEXDOG cannot guarantee that information presented on the Website matches the information presented on third-party websites and/or actual purchase conditions with a third party. Please be advised of these circumstances and always thoroughly check whether the purchase conditions and contents of your shopping cart on the third-party website, app or other online property match your preferences.

In cases in which the information on the Website does not match the information on a third-party website, app or other online property, FLEXDOG does not hold or assume any responsibility. If the User accesses a third–party website, app or other online property, he does so at his own risk and agrees that FLEXDOG will have no liability arising from the use of any such properties.

FLEXDOG does not guarantee the continuous operation of the Website which may at times be interrupted due to maintenance, malfunctions of hardware, malfunctions of software or force majeure. Nevertheless, FLEXDOG always strives for swift recovery of the Website's operability and functionality.

Additional Terms of Service

For the purpose of the User being able to make full use of the Website's services, FLEXDOG gathers and processes personal data of users, which are always handled securely and in accordance with all binding regulations and with FLEXDOG Privacy Policy published on the Website (you can find FLEXDOG Privacy Policy under this link). In accordance with FLEXDOG Privacy Policy, the User may always withdraw his consent to the processing of personal data, same as the collection and use of cookies (you can find FLEXDOG Cookie Policy under this link). We would like to inform you that in the event that the User does not grant the consent to the processing of personal data and/or disables the collection and use of cookies, the User may not be able to experience all of the Website's services in full capacity.

The Website and its contents, including without limitation all text, images, graphics and code contained in the Website, and its look and feel are owned by FLEXDOG, or by third-party providers, and are protected by copyright law. Neither the Website nor any of its contents may be modified or copied in whole or part in any form, including by framing, translation into other languages, incorporation into other websites or other publication, or be used to create any derivative work. By accessing and using the Website, the User agrees to not violate or infringe the terms mentioned above. Except where otherwise specified, you may view, copy and print the Contents only for your own and strictly non-commercial use.

The User also acknowledges that any use of tools or mechanisms resulting in the restriction of the operation or functionality of the Website, accessibility of the Website by other users or overall security of the Website is strictly prohibited.

User Account

The Website offers the User the possibility to set up a user account, the creation of which is conditional on the explicit and freely given consent to the processing of personal data. By setting up the user account, the User gets the ability to save favourites from the product catalogue, set notifications for price changes, availability of selected items or publication of new products in the product catalogue from followed brands and receive personalized Website search results.

In cases of violation and abuse of these terms and conditions, FLEXDOG reserves at his sole discretion a right to terminate the User account and restrict access to the Website.

Final Provisions

Legal relationships arising between FLEXDOG and the User (including legal relationships with a trans-national element) and all disputes relating to the use of the Website will be exclusively governed by the laws of the Czech Republic and all claims and disputes can be litigated only in courts of the Czech republic.

These terms and conditions are valid and effective from January 1, 2021, and FLEXDOG reserves a right to make changes to these terms and conditions at any time.  Any changes will be effective at the time of posting.
